1. Acceptance of Terms
1.1. These Terms of Service ("Terms") are a legally binding agreement between you and Kizizi Africa Ltd ("Kizizi," "we," "our," or "us"), the operator of the Kizizi Gigs platform.
1.2. By creating an account, accessing, or using the Kizizi Gigs mobile application or any related services (collectively, the "Platform"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
1.3. When you create an account, you will be asked to confirm that you have read and agree to these Terms. Your use of the Platform after that confirmation constitutes your acceptance.
2. Description of the Service
2.1. Kizizi Gigs is a gig matching marketplace platform that connects people who need short-term work done ("gig posters") with skilled workers ("workers"). Our core workflow is Post, Match, Earn:
- Post: Gig posters create gig listings describing the work needed, the budget, and the location.
- Match: Our system matches gig postings with nearby workers based on location, skills, and availability.
- Earn: Workers apply for and complete gigs, and payments are processed through the Platform.
2.2. The Platform is currently available as an Android mobile application distributed through the Google Play Store.
2.3. Kizizi is a marketplace, not a party to your transactions. We provide the technology that connects gig posters and workers. We are not a party to any agreement between them. See Section 4 for important details about our role.
2.4. We reserve the right to modify, update, suspend, or discontinue the Platform (or any part of it) at any time, with or without notice, for any reason. We are not liable to you for any modification, suspension, or discontinuation of the Platform.
3. Eligibility and Account Registration
3.1 Eligibility
3.1.1. You must be at least 18 years old to use the Platform. By creating an account, you represent and warrant that you are at least 18 years of age. If we discover that a user is under 18, we will terminate their account and delete their data.
3.1.2. You must have the legal capacity to enter into a binding agreement under the laws of Kenya.
3.1.3. You must not have been previously banned from using the Platform.
3.2 Account Registration
3.2.1. To use the Platform, you must create an account by signing in with your Google account. We receive your name, email address, and profile picture from Google.
3.2.2. After registration, you must complete your profile by providing additional information including your phone number, location, and skills. You cannot use the Platform's core features until your profile is complete.
3.2.3. You are responsible for maintaining the security of your Google account and your device. You are responsible for all activity that occurs under your account, whether or not you authorized it.
3.2.4. You may only have one account. Creating multiple accounts is prohibited and may result in termination of all accounts.
3.2.5. All information you provide must be accurate, current, and complete. You must update your information promptly if it changes.
4. Our Role as a Marketplace
4.1. Kizizi is a platform that facilitates connections between gig posters and workers. We are an intermediary marketplace.
4.2. We are not an employer, staffing agency, or labour broker. No employment, agency, partnership, joint venture, or independent contractor relationship exists between Kizizi and any user, whether gig poster or worker.
4.3. Workers provide services to gig posters, not to Kizizi. We do not direct, control, supervise, or manage any work performed through the Platform.
4.4. All service agreements are solely between the gig poster and the worker. Kizizi is not a party to these agreements and has no obligations or liability under them.
4.5. We do not guarantee the quality, safety, legality, timeliness, or outcome of any gig, the qualifications or identity of any user, or the ability of any user to complete a gig or make a payment.
4.6. Tax obligations: Each user is solely responsible for determining and fulfilling their own tax obligations arising from transactions on the Platform, including but not limited to income tax, withholding tax, and any applicable digital services tax. Kizizi does not provide tax advice and does not withhold or remit taxes on behalf of users.
5. User Responsibilities
5.1 General Responsibilities
5.1.1. You must comply with all applicable laws and regulations when using the Platform, including the laws of Kenya.
5.1.2. You must treat other users with respect. Kizizi is committed to a safe and professional environment.
5.1.3. You are solely responsible for the content you post, the gigs you create or apply for, the work you perform or commission, and your interactions with other users.
5.2 Gig Poster Responsibilities
5.2.1. Gig postings must be accurate, complete, and describe lawful work.
5.2.2. You must set a fair budget that reflects the scope of the work.
5.2.3. You must pay for completed work through the Platform. Taking payments off-platform is prohibited (see Section 6.4).
5.2.4. You must treat workers fairly and with respect.
5.3 Worker Responsibilities
5.3.1. You must only apply for gigs you are qualified and able to complete.
5.3.2. You must complete accepted gigs to the standard described in the gig posting.
5.3.3. You must communicate promptly with the gig poster about progress, delays, or issues.
5.3.4. You must receive payment through the Platform. Taking payments off-platform is prohibited (see Section 6.4).
6. Prohibited Uses
6.1. You must not use the Platform for any of the following:
Fraud and deception: - (a) Providing false or misleading information in your profile, gig postings, applications, reviews, or messages. - (b) Creating fake accounts, multiple accounts, or impersonating another person. - (c) Manipulating reviews - including posting fake reviews, paying for reviews, exchanging reviews, or retaliating against users who leave honest reviews. - (d) Misrepresenting your qualifications, skills, experience, or identity.
Off-platform transactions: - (e) Arranging or completing transactions outside the Platform to avoid platform fees. This includes exchanging contact information (phone numbers, email addresses, social media handles) for the purpose of transacting off-platform.
Harmful content and behaviour: - (f) Posting gigs for illegal activities or activities that violate any applicable law. - (g) Harassing, threatening, intimidating, or discriminating against any user on the basis of race, ethnicity, gender, religion, sexual orientation, disability, or any other characteristic. - (h) Sending spam, unsolicited commercial messages, or promotional content through the messaging system. - (i) Posting sexually explicit, violent, or otherwise objectionable content.
Platform abuse: - (j) Using automated tools, bots, scrapers, or scripts to access the Platform, collect data, or interact with other users. - (k) Attempting to access another user's account, data, or private information. - (l) Interfering with or disrupting the Platform, its servers, or its networks. - (m) Reverse-engineering, decompiling, or disassembling the Platform or any part of it. - (n) Circumventing any security features, access controls, or technical measures of the Platform.
Financial abuse: - (o) Using the Platform to launder money, finance terrorism, or engage in any other financial crime. - (p) Using fraudulent or unauthorized payment methods. - (q) Filing false disputes, chargebacks, or payment reversals.
6.2. We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account, removing content, and reporting illegal activity to law enforcement (see Section 15).
7. User-Generated Content
7.1 Content You Create
7.1.1. "User Content" means any content you create, upload, or share on the Platform, including gig postings (titles, descriptions, images), profile information (bio, profile photo), messages, reviews, and file attachments.
7.1.2. You retain ownership of your User Content. However, by posting User Content on the Platform, you grant Kizizi a non-exclusive, worldwide, royalty-free, transferable licence to use, display, reproduce, and distribute your User Content for the purpose of operating, promoting, and improving the Platform. For User Content that was publicly visible on the Platform (such as gig postings, reviews, and public profile information), this licence is perpetual and irrevocable and survives termination of your account. For private User Content (such as messages), this licence ends when the content is deleted in accordance with our Privacy Policy.
7.1.3. You represent and warrant that you have all rights necessary to post your User Content and that it does not infringe the intellectual property rights of any third party.
7.2 Content Standards
7.2.1. Your User Content must not violate the prohibited uses listed in Section 6.
7.2.2. Gig postings must describe lawful work and must not be discriminatory in their requirements.
7.2.3. Reviews must be honest and based on your genuine experience with the transaction. Reviews cannot be edited or deleted once posted.
7.2.4. Messages are private between the sender and receiver. You must not share another user's private messages publicly without their consent.
7.3 File Uploads
7.3.1. You may upload image files as attachments to gig postings, profile photos, and messages.
7.3.2. File uploads are subject to size, dimension, and file type restrictions as displayed in the app. We may update these limits from time to time.
7.3.3. You may delete your own file attachments. Kizizi reserves the right to remove any file that violates these Terms.
7.4 Our Right to Remove Content
7.4.1. We may remove or disable access to any User Content that violates these Terms, without prior notice.
7.4.2. We are not obligated to monitor all User Content, but we reserve the right to do so.
8. Intellectual Property
8.1. The Platform including its design, code, features, logos, trademarks, and all original content created by Kizizi is owned by Kizizi and protected by applicable intellectual property laws.
8.2. Subject to these Terms, you may access and use the Platform for its intended purpose. This right is personal, non-transferable, and may be revoked if you violate these Terms. The restrictions in Section 6 (Prohibited Uses) apply.
8.3. If you provide us with feedback, suggestions, or ideas about the Platform, you grant us the right to use them without restriction or compensation.
9. Payments, Fees, and Billing
9.1 How Payments Work
9.1.1. Kizizi facilitates payments between gig posters and workers. All payments are processed in Kenyan Shillings (KES) through Paystack, our third-party payment processor.
9.1.2. When a gig poster pays for a completed gig, the payment is processed through Paystack. Kizizi deducts its platform service fees, and the remaining amount is paid out to the worker.
9.2 Platform Service Fees
9.2.1. Kizizi charges a service fee on each transaction. This fee is deducted from the payment before the worker receives their payout. The fee consists of: - A poster fee charged to the gig poster - A worker fee deducted from the worker's payout
The current fee rates are always displayed in the app and may change from time to time.
9.2.2. All applicable fees will be clearly displayed to you before you confirm a payment or accept a gig, so you know the total cost or net payout in advance.
9.2.3. We may change our fee structure at any time. Updated fees will be reflected in the app and apply to transactions initiated after the change.
9.3 Payment Methods
9.3.1. Payments are accepted through the methods supported by Paystack in Kenya, which may include mobile money (e.g., M-Pesa) and card payments.
9.3.2. By making a payment, you authorize Paystack to process the transaction. Your use of Paystack is subject to Paystack's own terms of service and privacy policy.
9.4 Worker Payouts
9.4.1. Workers receive payouts to their registered mobile money account via Paystack.
9.4.2. We will process payouts promptly after a gig is marked as completed and payment has been confirmed. However, processing times may vary depending on your mobile money provider and network conditions.
9.4.3. It is your responsibility to ensure your mobile money details are correct and up to date. We are not liable for failed or misdirected payouts caused by incorrect account information you provided.
9.4.4. We reserve the right to withhold, delay, or offset any payout if we reasonably suspect fraud, Terms violations, chargebacks, or other financial irregularities associated with your account. Withheld funds may be used to offset any amounts you owe to Kizizi or to other users.
9.5 Mobile Money-Specific Terms
9.5.1. Mobile money transactions may be subject to network delays, service outages, or processing errors outside our control. We do not guarantee instant or uninterrupted payment processing and are not liable for delays or failures caused by third-party payment providers or mobile money networks.
9.5.2. Certain mobile money transactions may be irreversible once processed. You should verify all payment details before confirming.
9.6 No Subscriptions
9.6.1. Kizizi does not charge subscription fees. The Platform is free to download and use. We earn revenue solely through per-transaction service fees as described in Section 9.2.
9.7 Refunds and Cancellations
9.7.1. Before a gig is accepted by a worker: A gig poster may cancel a gig posting at any time before a worker accepts it, at no cost.
9.7.2. After a gig is accepted but before completion: If either party needs to cancel, contact our support team at support@kizizi.io. Cancellations at this stage are handled on a case-by-case basis.
9.7.3. After a gig is completed: Once a gig is marked as completed and payment has been processed, refunds are not available.
9.7.4. Platform service fees: Platform service fees are non-refundable. The service fee covers the cost of operating the Platform and providing the gig matching service, and is not contingent on the outcome of any gig.
9.8 Taxes
9.8.1. You are solely responsible for determining and fulfilling any tax obligations that arise from your use of the Platform, including income tax, withholding tax, and value-added tax (VAT) where applicable.
9.8.2. Kizizi does not provide tax advice and does not withhold or remit taxes on your behalf.
9.8.3. Prices and budgets displayed on the Platform may not include applicable taxes. It is your responsibility to account for any taxes you owe.
10. Disputes Between Users
10.1. Kizizi is a marketplace that facilitates connections between users. We are not a party to any service agreement between gig posters and workers, and we are not responsible for resolving disputes between users (see Section 4).
10.2. Any dispute arising from a gig including disputes about work quality, payment, no-shows, or incomplete work is solely between the gig poster and the worker. Users are encouraged to resolve disputes directly through the Platform's messaging system.
10.3. If you believe another user is engaging in illegal activity on the Platform, report it to the relevant law enforcement authorities and notify us at support@kizizi.io so we can take appropriate platform-level action (such as suspending the user's account).
10.4. Safety incidents: If a gig results in a safety concern, threat, or emergency, contact local emergency services immediately.
11. Affiliate Partner Program
11.1. Kizizi operates an Affiliate Partner Program that allows eligible users to earn commissions by referring new users to the Platform.
11.2 Eligibility and Enrolment
11.2.1. To participate, you must have an active Kizizi account in good standing.
11.2.2. Participation is subject to approval by Kizizi. We may accept or reject applications at our discretion.
11.3 How It Works
11.3.1. Approved affiliates receive unique referral codes. When a new user signs up using your referral code, the referral is attributed to you.
11.3.2. Commissions are earned based on qualifying transactions completed by users you referred, as defined by the program terms.
11.4 Payouts
11.4.1. Affiliate commissions are tracked in your affiliate account and paid out when you reach the minimum payout threshold that is displayed in the app.
11.4.2. Payouts are processed via the same method used for worker payouts.
11.5 Prohibited Affiliate Conduct
11.5.1. You must not use deceptive, misleading, or spammy methods to generate referrals, including but not limited to: - (a) Misrepresenting the Platform or the affiliate program. - (b) Sending unsolicited messages or spam. - (c) Creating fake accounts using your own referral code. - (d) Using paid advertising that implies an official Kizizi endorsement without our written approval.
11.6 Program Changes and Termination
11.6.1. We may modify the commission rates, program terms, or eligibility criteria at any time.
11.6.2. We may suspend or terminate your participation in the program at any time if you violate these Terms or the program rules. If your participation is terminated for a violation of these Terms or the program rules, all unpaid commissions are forfeited. If you voluntarily withdraw from the program, earned commissions that have reached the minimum payout threshold will be paid out.
12. Unclaimed Funds
12.1. Under the Unclaimed Financial Assets Act, 2011 (Kenya), Kizizi is required to report and surrender unclaimed financial assets to the Unclaimed Financial Assets Authority (UFAA).
12.2. Dormancy: Funds in your account (including worker payouts and affiliate commissions) are considered dormant if they remain unclaimed for one (1) year after becoming payable to you.
12.3. Before reporting: At least 90 days before reporting dormant funds to UFAA, we will attempt to contact you via push notification and/or email to the address associated with your account. You can prevent your funds from becoming dormant by logging in to the Platform, requesting a payout, or contacting our support team.
12.4. After reporting: If your funds are reported to and surrendered to UFAA, you may reclaim them directly from UFAA in accordance with their procedures.
12.5. Kizizi is not liable for any funds surrendered to UFAA in compliance with the law.
13. Privacy and Data Protection
13.1. Your privacy is important to us. Our collection, use, and sharing of your personal data is governed by our Privacy Policy which is a separate document from these Terms.
13.2. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.
13.3. Data processing under these Terms. By using the Platform, you acknowledge that we collect and process data as described in our Privacy Policy, including analytics data collected under our legitimate interest in improving the platform. If we introduce any consent-based processing in the future, that consent will be requested separately and will not be bundled with your agreement to these Terms.
13.4. Key points from our Privacy Policy relevant to these Terms: - We use Paystack to process payments. Payment data is shared with Paystack as necessary to complete transactions. - We collect your GPS location to match you with nearby gigs. - Your phone number is encrypted at rest and is never stored in plain text. - Your full mobile money account number is never stored. - You can request deletion of your account and data by contacting us. Requests are processed within 30 days. - Financial and transaction records are retained for 7 years as required by the Kenya Income Tax Act.
14. Third-Party Services
14.1. The Platform uses third-party services to provide its functionality. These include but are not limited to:

14.2. Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for the practices of third-party service providers.
14.3. We do not endorse, warrant, or assume responsibility for any third-party products, services, or content.
15. Termination
15.1 Termination by You
15.1.1. You may stop using the Platform at any time by logging out and uninstalling the app.
15.1.2. To close your account and request deletion of your data, contact us at support@kizizi.io. Your request will be processed within 30 days, consistent with our Privacy Policy.
15.1.3. Before closing your account, you must complete or cancel any active gigs and withdraw any available funds. We are not responsible for funds left in your account after you request account closure (see Section 12 for unclaimed funds).
15.2 Termination or Suspension by Kizizi
15.2.1. We may suspend or terminate your account, or restrict your access to the Platform, if: - (a) You violate these Terms, including any prohibited use in Section 6. - (b) You engage in activity that poses a risk to other users, the Platform, or Kizizi. - (c) Your account has been inactive for an extended period. - (d) We are required to do so by law or a court order. - (e) We reasonably believe your account has been compromised.
15.2.2. We will not disclose the reason for your suspension or termination. We may act immediately and without prior notice where the situation warrants it.
15.2.3. Suspensions and terminations are final and cannot be appealed.
15.3 Effect of Termination
15.3.1. Upon termination of your account: - Your right to use the Platform ends immediately. - We will process pending payouts for completed gigs, subject to our right to withhold funds under Section 9.4.4. Funds that are not withdrawn become subject to the unclaimed funds provisions in Section 12. - Your User Content may be retained as described in our Privacy Policy (e.g., reviews remain visible to other users; messages are retained per the retention schedule). Publicly visible User Content (reviews, gig postings) may remain on the Platform indefinitely under the licence granted in Section 7.1.2. - Personal data will be handled as described in our Privacy Policy, deleted or anonymized within 30 days of a deletion request, except for data we are legally required to retain.
15.3.2. The following sections survive termination of your account: Section 4 (Our Role as a Marketplace), Section 7.1.2 (content licence), Section 8 (Intellectual Property), Section 9.8 (Taxes), Section 12 (Unclaimed Funds), Section 16 (Disclaimers), Section 17 (Limitation of Liability and Waiver), Section 18 (Indemnification), Section 19 (Governing Law), and Section 20 (General Provisions).
16. Disclaimers
16.1. The Platform is provided on an "as available" basis. We use reasonable efforts to maintain the Platform's availability and performance, but we do not guarantee that: - (a) The Platform will be available at all times or without interruption. - (b) The Platform will be free of errors, bugs, or security vulnerabilities. - (c) Any specific results will be achieved through use of the Platform.
16.2. Marketplace disclaimers (see also Section 4): - (a) We do not verify the identity, qualifications, background, or suitability of any user, beyond basic account registration. - (b) We do not guarantee the quality, safety, legality, or outcome of any gig. - (c) We do not guarantee that a gig poster will find a suitable worker, or that a worker will find gigs. - (d) We do not guarantee the accuracy of information provided by users, including gig descriptions, skill claims, and reviews.
16.3. Third-party services: We do not guarantee the availability, performance, or security of any third-party service used by the Platform, including Paystack, Firebase, or mobile money networks.
17. Limitation of Liability and Waiver
17.1. Waiver of liability: To the maximum extent permitted by applicable law, you acknowledge and agree that Kizizi, its officers, directors, employees, and agents shall have no liability to you for any claims, damages, losses, or expenses of any kind arising out of or related to:
- Your use of or inability to use the Platform.
- The quality, safety, legality, timeliness, or outcome of any gig or service agreement between users.
- The conduct, actions, or omissions of any other user, whether online or offline.
- Payment processing errors, delays, or failures caused by Paystack, mobile money providers, or other third parties.
- Service interruptions, downtime, data loss, or technical issues.
- Unauthorized access to your account resulting from your failure to maintain the security of your credentials or device.
- Any content posted by users on the Platform.
- Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
17.2. Acknowledgement of risk: You acknowledge that Kizizi is a marketplace intermediary, that your use of the Platform is entirely at your own risk, and that you waive any and all claims against Kizizi arising from your interactions with other users or the outcomes of gigs arranged through the Platform.
18. Indemnification
18.1. You agree to indemnify, defend, and hold harmless Kizizi, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Your interactions with other users, including any dispute, claim, or injury arising from a gig.
- Your User Content, including any claim that it infringes a third party's intellectual property rights.
- Your use of the Platform in a manner not authorized by these Terms.
19. Governing Law and Jurisdiction
19.1. These Terms are governed by and construed in accordance with the laws of Kenya.
19.2. The courts of Nairobi, Kenya have exclusive jurisdiction over any disputes arising under these Terms.
20. General Provisions
20.1 Severability
20.1.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it will be severed. The remaining provisions will continue in full force and effect.
20.2 Entire Agreement
20.2.1. These Terms, together with our Privacy Policy constitute the entire agreement between you and Kizizi regarding your use of the Platform. They supersede all prior agreements, understandings, and representations, whether written or oral.
20.3 No Waiver
20.3.1. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Kizizi.
20.4 Assignment
20.4.1. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
20.4.2. Kizizi may assign these Terms, in whole or in part to any successor or affiliate including in connection with a merger, acquisition, corporate reorganization or sale of assets. We will notify you of any such assignment.
20.5 Force Majeure
20.5.1. Kizizi is not liable for any failure or delay in performing its obligations under these Terms caused by events beyond our reasonable control, including but not limited to: natural disasters, acts of government, wars, civil unrest, epidemics, power outages, telecommunications failures, internet service disruptions, mobile money network outages, or third-party service provider failures.
20.6 Communications
20.6.1. By using the Platform, you consent to receiving transactional communications from us via push notification and email, including notifications about gigs, messages, payments, and account activity. These are essential service communications, not marketing.
20.6.2. Marketing communications, will be sent only with your prior opt-in consent and you may opt out at any time in accordance with Section 84A of the Kenya Information and Communications Act.
20.7 Notices
20.7.1. Notices from Kizizi to you will be sent via push notification, email to the address associated with your account, or in-app notification. You are responsible for keeping your contact information current.
20.7.2. Notices from you to Kizizi should be sent to support@kizizi.io.
21. Changes to These Terms
21.1. We may update these Terms from time to time. When we make changes:
21.1.1. We will update the "Last updated" date at the top of these Terms.
21.1.2. For material changes, we will notify you at least 14 days before the changes take effect, via push notification or email.
21.1.3. Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the changes.
21.1.4. If you do not agree with the changes, you should stop using the Platform and request account closure (see Section 15.1). Active gigs and pending payments will be handled as described in Section 15.3.
